As the financer of mortgages, commercial properties, and other properties secured by improved real estate, banks and other real estate lenders are in a key position to require property owners to maintain adequate insurance. For this reason, the Flood Disaster Protection Act of 1973 made it the lender's responsibility to determine which properties are in areas most prone to flooding and further, become the enforcer for the purchase and maintenance of flood insurance protection.
